FORZ LLC Terms of Service
Introduction
Welcome to Forz!
Forz LLC (“Forz”) provides a software-as-a-service (SaaS) platform designed to support field service businesses in managing customers, jobs, and billing. By accessing or using the Forz platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please refrain from using our platform.
1. Acceptance of Terms
By creating an account or using Forz, you accept these Terms of Service (“Terms”) and all policies referenced herein. These Terms apply to all users of the Forz platform, including account administrators and field service professionals.
2. Definitions
- Forz Platform: The software-as-a-service application developed and owned by Forz LLC, designed to support field service businesses.
- User: Any individual or entity accessing and using the Forz platform.
- Account Administrator: The individual responsible for managing the Forz account, including inviting other users, assigning roles, and handling payments.
3. User Accounts
To access the Forz platform, users must create an account. You agree to provide accurate and complete information and to keep your account information up-to-date. Account administrators are responsible for the actions of all users they invite to their account.
4. License and Usage
Forz grants you a limited, non-exclusive, non-transferable license to access and use the Forz platform for business purposes related to field service management. Unauthorized copying, modification, distribution, or sublicensing of any part of the Forz platform is prohibited.
5. User Responsibilities
You agree to:
- Use the Forz platform only for lawful purposes.
- Protect your account information and notify Forz immediately if you suspect unauthorized access.
- Comply with all applicable laws and regulations while using the platform.
You must not:
- Attempt to reverse-engineer, disassemble, or otherwise attempt to derive the source code of the Forz platform.
- Misuse or exploit any aspect of the platform, including attempting to bypass usage limits or restrictions.
6. Data Ownership and Privacy
Your data remains your property. Forz acts as a processor for the information you provide and processes it in compliance with our Privacy Policy. We will not share your data with third parties except as necessary to provide the services or as required by law.
Data Retention and Deletion Policy: Upon account cancellation, Forz retains user data for a 30-day grace period, allowing for reactivation. After this period, personal data and content are permanently deleted. Users can request immediate deletion at any time. Email notifications are sent for both cancellation and final deletion.
7. Payment and Subscription
Forz operates on a subscription basis, offering both monthly and yearly payment options. By subscribing, you agree to pay the specified subscription fee and any applicable taxes. Forz does not provide prorated refunds for cancellations before the end of the billing period. Failure to pay may result in suspension or termination of your account. Payments are processed via Stripe, and by using Forz, you agree to Stripe’s terms and conditions.
Additional Users:
The subscription fee is based on the number of users associated with your account. If additional users are added during the billing period, you agree to pay the applicable fees for those users, which will be charged on a prorated basis for the remaining term of your subscription. These charges will be reflected in your next billing cycle.
8. Trial Period
Forz offers a 14-day free trial for new users. At the end of the trial period, you will be required to subscribe to a paid plan to continue using the platform.
9. Service Availability
Forz is a cloud-based platform, and while we strive to provide continuous service, we do not guarantee uninterrupted access. Downtime may occur due to maintenance, system updates, or unforeseen circumstances. Forz is not liable for any interruption or loss of data resulting from downtime. Forz guarantees a 99.9% uptime for its services.
10. Support and Service Level Agreement (SLA)
Forz provides the following support and service commitments:
Response Times:
- Critical issues: 1-hour response, 4-hour resolution target
- Major issues: 4-hour response, 8-hour resolution target
- General inquiries: 24-hour response
Support Hours:
- Technical support: 24/7/365 for critical issues
- General support: Monday–Friday, 9 am–6 pm EST
Issue Resolution:
- System outages: Handled immediately
- Bug fixes: Included in regular maintenance
- Feature requests: Evaluated bi-weekly
Support Channels:
- Email support
- Ticket system (available at all times)
- Live chat during business hours
- Emergency phone line for critical issues
11. Third-Party Integrations
Forz allows integration with third-party services. By enabling integrations, you acknowledge and agree to the terms of those third-party services. Forz is not responsible for data sharing, storage, or use by these services.
12. Termination
You may terminate your subscription at any time. Forz reserves the right to suspend or terminate accounts that violate these Terms. Upon termination, access to the platform and associated data will be revoked after the 30-day grace period.
13. Limitation of Liability
To the maximum extent permitted by law, Forz is not liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the platform, including loss of revenue or data, even if advised of the possibility of such damages.
14. Indemnification
You agree to indemnify, defend, and hold harmless Forz, its affiliates, employees, and agents from any claims, losses, liabilities, and expenses arising from your use of the platform, your breach of these Terms, or your violation of any rights of a third party.
15. Modifications to Terms
Forz reserves the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of the platform after changes are posted constitutes acceptance of the modified Terms.
16. Governing Law
These Terms are governed by and construed under the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Delaware.
